Website terms of use

Introduction and scope

These Website Terms of Use ("Terms") apply to websites and pages we operate under engineeringproductdesign.org, including https://www.engineeringproductdesign.org and any other subdomains or paths that show or link to these Terms, and everything we publish there (together, the "Site"). "Engineering Product Design", "we", "us", and "our" mean the party operating the Site.

The Terms cover use of this Site only. They are not the contract for engineering, product design, or consultancy work, nor for statements of work, proposals, or deliverables. Those relationships are set out only in separate written agreements we sign with each client. Nothing you read here replaces or changes those signed documents.

If you do not accept these Terms, do not use the Site.

Agreement and eligibility

Using the Site (including viewing pages, downloading materials we allow, or sending a form) means you accept these Terms and our Privacy & cookies notice at https://www.engineeringproductdesign.org/privacy, which explains how we handle personal data for the Site.

You confirm you can enter contracts in your place of residence. If you use the Site for a company or other entity, you confirm you are allowed to bind it, and "you" includes that entity. The Site is not aimed at people who cannot legally agree to online terms where they live. If that is you, please do not use the Site.

Acceptable use

Use the Site lawfully and as these Terms describe. You agree not to:

Prohibited conduct

Break applicable laws or regulations. Infringe anyone's intellectual property or privacy. Upload malware or anything meant to harm systems. Probe or attack the Site or our systems without permission. Interfere with how the Site or related networks run.

Automated access

Run bots, scrapers, or similar tools to pull data from the Site in bulk, bypass protections, or overload our systems. Public search engines may index the Site as usual where our robots.txt allows.

Misrepresentation

Pretend to be someone else, lie about who you are or who you work for, or use the Site to send spam or bulk messages people did not ask for.

Intellectual property

Unless we say otherwise, we and our licensors own the Site and its components: software, layout, text, images, logos, marks, audio, video, and the way content is selected and arranged ("Site Content"). Site Content is protected by copyright, trademark, and other rights.

We give you a limited, revocable, non-exclusive licence to view the Site and Site Content for your own use or your organisation's internal use, including deciding whether to contact us. You may not copy, change, distribute, sell, rent, sublicense, publicly show, publicly perform, or build derivative works from Site Content, except where we offer a download or share feature, or where the law lets you quote briefly (for example fair dealing or fair use).

Leave copyright and trademark notices in place. Names, case studies, and summaries on the Site describe work at a high level. Detailed designs, CAD, firmware, schematics, tests, and client deliverables stay governed by the contracts that produced them.

Informational content, not professional advice

The Site is for general information and to describe what we do. It is not engineering, product, safety, regulatory, or legal advice. Using the Site does not create a consultant–client or lawyer–client relationship. Diagrams, photos, numbers, and examples are simplified and may not fit your product, materials, site conditions, or regulators.

Engineering examples

Technical write-ups and project notes are examples only. Ratings, stack-ups, analyses, or test results from one job do not automatically apply to another design. You need your own checks, qualifications, and review for your requirements.

Simulations and estimates

Where we mention analysis, margins, or performance, treat it as illustration, not a promise. Real results depend on materials, suppliers, manufacturing spread, how the product is used, and the standards that apply to you.

Forms, messages, and feedback

If you contact us through the Site, you state that what you send is accurate to the best of your knowledge and is not illegal, defamatory, or infringing.

You give us a non-exclusive, worldwide, royalty-free licence to handle your messages only to reply to you, run and improve the Site, and manage our dealings with you, as explained in our Privacy & cookies notice at https://www.engineeringproductdesign.org/privacy.

Do not send confidential or proprietary information through the Site unless we have first agreed in writing on how to receive it. If you send unsolicited ideas or materials, we may use them without paying you or owing you a duty, except where the law says otherwise.

Third-party links and services

The Site may link to other sites or services we do not control. We add links for convenience. We are not responsible for their content, policies, or practices. You use third-party sites at your risk, under their terms and privacy notices.

Some functions rely on suppliers (for example hosting, analytics, or form delivery). How they process data is set out in our Privacy & cookies notice at https://www.engineeringproductdesign.org/privacy where it matters.

Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site and Site Content are provided "as is" and "as available". We exclude all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any implied warranties from course of dealing or trade usage.

We do not guarantee that the Site will run without interruption, on time, securely, or without errors; that faults will be fixed; or that the Site or our servers are free of harmful code. You use the Site at your own risk.

Limitation of liability

To the fullest extent permitted by applicable law, Engineering Product Design and its directors, employees, contractors, suppliers, and affiliates shall not be liable to you for any indirect or consequential loss or damage; loss of profit, sales, business, revenue, anticipated savings, goodwill, opportunity, or contracts; loss or corruption of data; business interruption; exemplary or punitive damages; or pure economic loss, in each case arising out of or in connection with the Site, Site Content, or these Terms (including your use of or inability to use the Site). This applies whether we were told such loss was possible or not, and whether the claim arises in contract, tort (including negligence), misrepresentation, restitution, under statute, or otherwise.

To the fullest extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or in connection with the Site, Site Content, or these Terms shall not exceed one hundred pounds sterling (£100). That limit applies once in aggregate (not per claim or per incident), covers all heads of loss together, and includes interest and costs where a court awards them against us. Separate fees you pay under signed professional services agreements are governed solely by those agreements and do not increase this cap.

Some jurisdictions do not allow certain exclusions or caps; where that applies, we limit our liability to the minimum extent permitted by law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited (including for death or personal injury caused by negligence where the law forbids exclusion, or for fraud or fraudulent misrepresentation). If you are a consumer, your mandatory statutory rights under the law of your country of residence are not affected.

Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Engineering Product Design and its directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your misuse of the Site, or your breach of applicable law or third-party rights.

Privacy

How we collect and use personal information for the Site is described in our Privacy & cookies notice at https://www.engineeringproductdesign.org/privacy. Using the Site means you have seen that notice.

Changes and suspension

We may change these Terms. When we do, we update the effective date at the top of this page and may post a short notice on the Site for important changes. If you keep using the Site after changes go live, you accept the updated Terms as far as the law allows. If you disagree, stop using the Site.

We may stop or suspend the Site, or any part of it, at any time, with or without telling you first. We are not liable to you for doing so.

Governing law, disputes, and general

These Terms and any dispute or claim arising out of or in connection with them, the Site, or their subject matter (including non-contractual disputes) are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law rules that would apply another jurisdiction's laws, subject to any mandatory rules that apply in your country of residence if you qualify as a consumer.

Subject to mandatory jurisdiction rules that apply to you as a consumer, the courts of England and Wales have exclusive jurisdiction. Nothing in these Terms limits any right we may have to bring proceedings in another court for provisional or protective relief or to enforce a judgment.

If any provision of these Terms is invalid or unenforceable, the rest remains in full force and effect. Failure to enforce a right is not a waiver. You may not assign or transfer these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and us regarding the Site and supersede prior understandings on that subject. Nothing in these Terms confers rights on third parties except where applicable law says otherwise.
